Changes to this Privacy Policy

We reserve the right to modify this Privacy Policy at any time. All changes will be effective immediately upon posting of the updated Privacy Policy on the Website and by accessing or using the Website after any changes are made, you agree to those changes. Material changes will be clearly posted on the Website or otherwise communicated to you (e.g., via email).  

Information We Collect and How We Use It

SharperImage.com is committed to protecting your privacy. The information we collect generally falls into the following categories:  

·       Information collected through your use of the Website, for example, user activity, data collected by the servers used to operate the Website (e.g., IP addresses and device information), data collected by analytics and advertising services, data collected when you connect using or share information via social media platforms, and data collected by cookies and tracking technologies.

·       Information that you voluntarily submit to us, for example, your contact information.  

Collection.  Personal data collected is used to facilitate the placement and delivery of your order with SharperImage.com. Your details are shared with our credit card processor for payment authorization, with our warehouse(s) and shipment carriers for order delivery, and with our financial accounting systems for general ledger purposes. We will collect any and all information that you choose to submit to us through, using, or in connection with the Website, including, without limitation, the types of information described below.  

Purposes For Which We Process Your Information. In addition to the uses and sharing described above, Company and its suppliers may use and disclose Collected Information as described below.

• Completing Orders. In order to complete your order or to satisfy your request for information, you will be asked to provide us with certain personal information. We offer 1024-bit SSL encryption, which encrypts your personal and credit card information as it is transferred over the Internet.

• We electronically verify each order with the credit company, returning an order confirmed message only if the issuing bank authorizes it. We do not store your credit card information in our system. Our experienced staff manually checks all orders that appear unusual, and has the right to cancel  any order we feel is not valid.
  
  
• Chat Feature. When you access our Chat feature, our third-party service provider may record your chat for quality and training purposes. That Chat may be shared with us for customer service reasons. By using Chat, you consent to these uses.
  
  
• Personalization; Advertising; Analytics. To tailor the content and information that we may send or display to you, to suggest personalized help and instructions, and to otherwise personalize your experience while visiting or using our Website. Additionally, we may collect your information and share it with our third party service providers to understand how our Website is used and to improve the Website (as described further in the "Analytics" section of the Privacy Policy below). Further, we may use your information for us, or our third party service providers, to use that information to target advertisements for goods and services and to display those advertisements on other websites. The information collected may be associated with your personal information. • Promotional Communications. We may, to the extent permitted by applicable law and in accordance with your preferences, use Collected Information to send you promotional communications about SharperImage.com and our products and services. We will obtain your prior consent for such promotional communications solely to the extent required by applicable law. In order to provide you with a personalized experience, these communications may be tailored to your preferences based on, for example, inferences we make using your visits to the Website or the links you click on in SharperImage.com emails. Please note that pixel tags, cookies and other online trackers may be used within emails to track your interactions with those websites and when emails are opened. You may opt out of receiving promotional communications from us at any time by following the unsubscribe instructions contained in the applicable email or by contacting us using the contact information provided below under "Contact Us."

SharperImage.com Mobile Message Service. The SharperImage.com mobile message service (the "Service") is operated by Camelot SI LLC. Your use of the Service constitutes your agreement to the terms and conditions ("Sharper Image Mobile Message Program Terms and Conditions") included in our Terms of Use . By consenting to SharperImage.com's SMS/text messaging service, you agree to receive recurring promotional SMS/text messages from and on behalf of SharperImage.com through your wireless provider to the mobile number you provided. When you consent to receive recurring SMS/test messages from us, we will honor your request, even if your mobile number is registered on any state or federal Do Not Call list. SMS/text messages may be sent using an automatic telephone dialing system or other technology. Service-related messages may include updates, alerts, and information (e.g., order updates, account alerts, etc.). Promotional messages may include promotions, specials, and other marketing offers (e.g., cart reminders).

You understand that you do not have to sign up for recurring SMS/text messages in order to make any purchases, and your consent is not a condition of any purchase with SharperImage.com. Your participation in this program is completely voluntary.

With respect to SMS/text message marketing, we will not share your opt-in status to a SharperImage.com SMS marketing campaign with any third party for purposes unrelated to providing you with the actual SMS marketing campaign, provided that we may still share your opt-in status for fraud prevention. We may share your personal information, including your SMS opt-in or consent status, with third parties that help us provide our messaging services, including but not limited to platform providers, phone companies, and any other vendors who assist us in the delivery of text messages. We may also use and disclose your information pursuant to a subpoena, court order or other legal process, to establish or exercise our legal rights, or defend against legal claims. Note that, even if you opt out of receiving promotional communications from SharperImage.com, you may still receive administrative communications from us with respect to your use of the Website.  

You may opt-out of the Service at any time. Text the single keyword command  STOP or other keywords as noted in the Terms of Use to cancel. You'll receive a one-time opt-out confirmation text message. No further messages will be sent to your mobile device, unless initiated by you. If you initiate a SMS/text message after opting out, such initiation constitutes your consent to receive SMS/text messages and overrides any previous opt-out. If you have subscribed to other SharperImage.com mobile message programs and wish to cancel, except where applicable law requires otherwise, you will need to opt out separately from those programs by following the instructions provided in their respective mobile terms.

• Evaluation and Improvement. We may use and disclose Collected Information to analyze, develop, and improve the content, materials, products, and services that we provide; to inform marketing and communication plans and strategies; to understand user demographics and preferences; to analyze the effectiveness of the Website; and to evaluate user needs and customize Website content and the user experience. To better understand how users access and use our Website, both on an aggregated an individualized basis, including monitoring, evaluating, and analyzing which features and portions of the Website are most popular; for troubleshooting, for statistical purposes, including, for example, identifying geographic regions of visitors to our Website; evaluating frequently asked questions from visitors; and for other statistical purposes.  

• Quality Assurance. In order to perform quality assurance and to continuously improve our customers’ experience, to assist with fraud identification, and to assist our customer relationship representatives (for example, through representatives in our call center), we use tools to monitor and record certain user experience information, including, without limitation, audio of customer service calls and information resulting from such calls.  

• De-Identified and Aggregated Data. We may de-identify and/or aggregate personal information and User-Generated Content, and aggregate other Collected Information, and use and disclose that aggregate and/or de-identified data for our business purposes, in each case to the extent permitted by applicable law. To the extent we create de-identified and/or aggregate personal information, we take reasonable measures designed to maintain such information in de-identified and/or aggregate form. Once de-identified or aggregated, we will not attempt to re-identify the data (other than to confirm our de-identification and aggregation processes worked).  

• Lawful Processes; Protection of SharperImage.com. We may use and share Collected Information in accordance with and in response to regulatory authorities, courts with competent jurisdiction, valid law enforcement requests, governmental agency requests, emergency services, and other necessary third parties for legal, protection, security, and safety purposes (e.g., to comply with laws or regulations, to respond to subpoenas and legal processes, to perform credit checks, to protect the safety of our employees, agents, and customers, or any other person). We may use Collected Information and share it with third parties if we believe doing so is necessary or appropriate to protect our rights or the rights of others, including to enforce our agreements, policies, and terms, to bring legal action, to protect our operations and assets, or to pursue remedies or limit damages that we may sustain.   

• Business Transactions. If SharperImage.com undergoes a change in control, acquisition, merger, reorganization, asset sale (in whole or in part), or similar transaction, we may transfer, sell, share, or otherwise disclose Collected Information to the subsequent owner(s) or successor(s) of those transactions. We may also disclose Collected Information in connection with the evaluation of those transactions. Those owner(s), successor(s), and other recipients will be bound by this Privacy Policy as it applies to the information disclosed. Also, if SharperImage.com or any of its assets are acquired or if SharperImage.com goes out of business, enters bankruptcy, or goes through some other change in control or reorganization, Collected Information may be one of the assets transferred to or acquired by a third party.  

• With Your Consent. With your consent, we may use and share your personal information and other Collected Information in ways not specifically described in this Privacy Policy.  

• User-Generated Content. You are responsible for any data, information, images, messages, documents, and other content that you enter, submit, create, post, upload, transmit, or otherwise provide through or using the Website, including by providing feedback, participating in forums or discussion boards, by uploading or providing photographs, by submitting product reviews or testimonials, by commenting on blog posts, or by populating a user account or profile (where such options are made available to you). "User-Generated Content" means all data, feedback, information, images, messages, documents, and other content that is entered into, submitted to, posted on, uploaded to, transmitted, streamed, created, or displayed using, or otherwise provided via or using the Website by you or on your behalf. All User-Generated Content is provided at your own risk. We cannot guarantee that User-Generated Content you provide will not be viewed by unauthorized persons. You understand that, even after removal, copies of User-Generated Content you have provided may remain viewable in cached and archived pages and may have been copied or stored by Internet archives and other Website users. We will make User-Generated Content available, including publicly available, to other Website users and to the public, as applicable and at its sole discretion, and will use and disclose User-Generated Content for the purpose for which it was provided as indicated at the point of collection. Like most Internet retailers, SharperImage.com collects some computer information to enhance its product/service offerings and personally tailored marketing, such as computer configuration; Internet Protocol address; the URL of the website that sent you to the SharperImage.com Website; the URL of the website that you went to after leaving the SharperImage.com Website; and/or search terms that directed you to our Website.

We use cookies, pixels, java script, and other tracking mechanisms to track information about your use of the Sharperimage.com Website and to enhance your experience. We may combine this information with other information, including personal information we collect about you.

• Cookies. Cookies are alphanumeric identifiers that we transfer to your computer’s hard drive through your web browser for record-keeping purposes. • Clear GIFs, pixel tags and other technologies. Clear GIFs are tiny graphics with a unique identifier, similar in function to cookies. In contrast to cookies, which are stored on your computer’s hard drive, clear GIFs are embedded invisibly on web pages. We may use clear GIFs (also referred to as web beacons, web bugs or pixel tags), in connection with our Services to, among other things, track the activities of users of our Services, help us manage content, and compile data and statistics about the usage of our Services, including keeping track of items you put into your shopping cart, including when you have abandoned your cart, which is used to determine when to send cart reminder messages via SMS. We and our third-party service providers also use clear GIFs in HTML emails to our customers, to help us track email response rates, identify when our emails are viewed, and track whether our emails are forwarded.
  
  
• Do-Not-Track Signals. Our Website does not currently respond to do-not-track signals. You may, however, disable certain tracking as discussed above (e.g., by disabling cookies in your browser).  

You may choose to set your web browser to refuse cookies, or to alert you when cookies are being sent. However, by doing so, some parts of our Website may not be accessible and/or function properly. You can refuse cookies by turning them off in your browser.

The information we collect is used to improve our Website, to notify consumers about updates to our Website and for special offers and promotions. Also, SharperImage.com may provide aggregate statistics about our online sales, traffic patterns and related site information to reputable third-party vendors, but these general statistics will include no personally identifying information.

We will periodically send to your mailing or e-mail address product news and updates that you may find of interest, and we do sometimes share customer information with third parties, which may include marketing partners, for commercial purposes. The above excludes SMS/text messaging originator opt-in data and consent; this information will not be shared with any third parties.

We may also collect information about you, including personal information, from third-party sources. For example, we collect certain personal information about you from marketing research firms in order to improve our future marketing efforts and make them more efficient. This information may include name, interests, and publicly-observed data like shopping behavior. We may combine this information with the Personal Information we collect from you. We will treat any combined information as Personal Information pursuant to this Privacy Policy.

Disclosures to Third Parties 

Pursuant to and consistent with the purposes for collecting your information as set forth in this Privacy Policy, we disclose certain categories of personal information to third parties for a business (or other) purpose. 

• To our Affiliates, Subsidiaries, and Related Entities: Based on how you use the Website and the information that you provide to or request from us, we may disclose your name, contact information, and related Collected Information with our affiliated companies who have products or services that we think may be of interest to you. By providing us your Collected Information and using the Website, you hereby direct us to disclose your information to our affiliates, subsidiaries and other related entities. Our affiliated companies may contact you directly with respect to such products and services, provided that if applicable law requires, your prior consent will be obtained. You may opt out of receiving communications from any such affiliated company pursuant to that affiliate’s own policies. You may opt out of receiving communications from us by contacting us using the information below under "Contact Us."  

• To Our Third-Party Suppliers and Service Providers: We will disclose Collected Information to our and our affiliates’ respective suppliers, vendors, and service providers as necessary for us to provide the Website and our products and services to you and to engage in the use and sharing of Collected Information as permitted by this Privacy Policy and applicable law. These third parties include, without limitation, our website management and hosting suppliers, marketing and advertising partners and service providers, customer support providers, those handling the processing and delivery of mailings, cloud storage providers, website analytics providers, payment processors (if and as applicable), product installers, and email service suppliers. Our service providers are authorized to and may use and disclose Collected Information as necessary for them to provide the applicable products and services to us and as provided by their own privacy policies and our agreements with those third parties. 

Marketing Preferences

We would like to send you information about our products and services that we think you might like. We may send you direct marketing communications, product information and promotional offers:

• If you have consented to receiving such communications from us;
• If we have an existing business relationship with you and can rely on your implied consent;
• If you are from a country where the laws permit us to send you such communications based on our legitimate interests, if you have bought a product or service from us, and have not opted out of receiving communications from us (for example the EEA or UK); or
• If you are in or from a location where the laws permit us to send you such communications.

The marketing communications we send will be in relation to our own products or services. Your personal data will not be used for third-party direct marketing unless separate explicit consent has been collected from you for that, or you are in or from a location where the laws permit such processing.

• Email marketing (if applicable): Where we have a legal basis, we may send emails about our store, new products, and other updates.
• SMS/text message marketing (if applicable): We may send text messages about our store, new products, and other updates. Updates include Checkout Reminders. With your consent, the website uses webhooks and cookies to help keep track of items you put into your shopping cart including when you have abandoned your cart and this information is used to determine when to send cart reminder messages via SMS/text message (see our “Marketing Preferences” section for more information).

We will process all requests as soon as possible, but please note that due to the nature of our IT systems and servers it may take a few days for any opt-out request to be implemented.

Dispute Resolution

In the interest of resolving disputes between you and SharperImage.com in the most expedient and cost effective manner, you and SharperImage.com agree that any dispute arising out of or in any way related to these messaging terms and conditions ("Messaging Terms") or your receipt of text messages from SharperImage.com or its service providers will be resolved by binding arbitration. Arbitration is less formal than a lawsuit in court. Arbitration uses a neutral arbitrator instead of a judge or jury, may allow for more limited discovery than in court, and can be subject to very limited review by courts. Arbitrators can award the same damages and relief that a court can award. This agreement to arbitrate disputes includes all claims arising out of or in any way related to these Messaging Terms, or your receipt of text messages from SharperImage.com or its service providers whether based in contract, tort, statute, fraud, misrepresentation, or any other legal theory, and regardless of when a claim arises. YOU UNDERSTAND AND AGREE THAT, BY AGREEING TO THESE MESSAGING TERMS, YOU AND SharperImage.com ARE EACH WAIVING THE RIGHT TO A TRIAL BY JURY OR TO PARTICIPATE IN A CLASS ACTION AND THAT THESE MESSAGING TERMS SHALL BE SUBJECT TO AND GOVERNED BY THE FEDERAL ARBITRATION ACT.

Security

If you are ever a victim of credit card fraud, the Fair Credit Act specifies that your credit card company can hold you liable for no more than $50 in fraudulent charges to your account. With sharperImage.com, you'll be reimbursed for any amount up to $50 billed to you by your credit card company for fraudulent charges to your account if the credit card number was obtained from purchases made at sharperImage.com while using our secure server. For this protection, you must promptly notify your credit card company of any fraudulent charges and follow the procedures for doing so as outlined in your credit card agreement.

How You Can Tell You're Browsing a Secure Website. In order to be sure that information transferred between your browser and the SharperImage.com server is secure, it is important to be aware of the security information available to you through your browser. Once you enter the Checkout process (when you're ready to purchase the items you have put into your shopping basket), your connection to our server becomes secure. To confirm this, look at the bottom of your browser window. If you see an unbroken key or a closed lock (depending upon your browser), you can be sure that your information is secure. You can also ensure security by checking the URL line of your browser. When you enter the secure area of our site, the first characters of the site address will change from "http" to "https".

Data Collection and Storage in a Secure Environment. In several areas of our site, we ask you to provide information by filling out and submitting an online form. These areas include: Checkout, where we ask for name, optional business name, billing address, shipping address, phone number, email, credit card and other information needed to complete your order. Optional Email Registration, where we ask for your email address. Optional Account Registration, where we ask for your name and email address and give you the opportunity to store your bill-to and ship-to details for easy online gift giving.

Once you've registered, you may click on My Account (at the top of any page) to edit or delete your information. All information relating to our customers is stored in a PCI compliant secure hosted environment and credit card information is never stored. If you are a guest user, please make your deletion request via email at customerservice@sharperimageonline.com or by phone at 877-714-7444.

Order and returns history are maintained in order to facilitate primary business operations between SharperImage.com and customers of our eCommerce store.

Children’s Privacy

Our Services are not targeted to children under thirteen (13) years of age and we do not knowingly collect personal information from children under 13. If we discover that a child under 13 has provided us with personal information, we will take steps to promptly delete such personal information from our systems.  

State Privacy Disclosures

As stated above, SharperImage.com does not respond to Do Not Track requests. A customer is able to control tracking activity via their browser settings if they desire to disable websites from tracking certain information regarding their browsing sessions.

Requests for information under your relevant state’s privacy laws, where applicable*,  may be made via the contact sources above.  You have the right to request information regarding the data collection, storage, and use as described above for your personal information within a 12-month lookback period. At any time, you may submit a request to delete information we have about you, or deactivate your account, if you have an account with us, by contacting us at customerservice@sharperimageonline.com or writing to us at the address above. California residents may request that we delete all of the information that we hold about them, but please note that there are exemptions to the right to delete. 

The information collected is done so for business operations purposes and is necessary to facilitate the transactions between SharperImage.com and a consumer, including but not limited to: order placement, shipment, financial accounting, payment authorizations, prevention of fraud and malicious acts, to improve customer experience, to provide customer communications, for marketing purposes, and to identify and repair errors that impair existing and intended functionality.

You will not be discriminated against for exercising your rights.

Shine the Light. Under California’s “Shine the Light” law (Cal. Civ. Code § 1798.83), California residents who provide us their personal information are entitled to request and obtain from us, free of charge, information about the personal information (if any) we have shared with third parties for their own direct marketing use; such requests may be made once per calendar year for information about any relevant third party sharing in the prior calendar year. If you are a California resident and would like to make such a request, please submit your request in writing by emailing us at customerservice@sharperimageonline.com, using the subject line "Request for California Privacy Information." In your request, please attest to the fact that you are a California resident and provide a current California address. We will reply to valid requests by sending a response to the email address from which you submitted your request. Please note that not all information sharing is covered by the "Shine the Light" requirements and only information on covered sharing and the relevant details required by the Shine the Light law will be included in our response.
